Neonatal malpractice claims in Italy: how big is the problem and which are the causes?

Medical errors are topics of increasing importance in neonatology. Very few data are available on neonatal malpractice claims. We report the first data obtained in Italy on neonatology regarding a wide population study during a 6-year survey. Data concerning 191 claims regarding delivery room (n = 77; 38.74%), nursery (n = 72; 37,69%), NICU (n = 42; 21,98%) and the transport system (n = 3; 1.57%) are presented and discussed. On data allow an analysis of main causes and suggest how to face the problem.

As recently as the 1980s, it was not uncommon for paediatric surgeons to operate on infants without anaesthesia. Today, the same omission would be considered criminal malpractice, and there is an increased concern with the possibility of consciousness in the earliest stage of human infancy. Forensic obstetrics attracts much attention from forensic experts and the public owing to the professional, legal, public health, and not inconsiderable social-emotional aspects and directly correlates with maternal, fetoneonatal, and iatrogenic risk factors. Modern obstetrics and fetomaternal medicine must not be quantified and qualified based only on perinatal disease but also according to current obstetric problems that burden forensic obstetrics. Therefore, high-risk obstetrics as a significant medico-legal problem should be viewed from the point of view of the entire perinatal period with possible long-term consequences, hence the monitoring of complete perinatal and infant morbidity is of immediate importance for quality control and risk control in the profession.
